Full Contest Rules and Regulations
1. This contest commences on or around 12:01 am AST on Monday October 6, 2008 and continues until 11:59 pm AST on Monday March 30, 2009, the Contest Closing Date. To be eligible, online stories and/or wellness videos must be received by 11:59PM AST Monday, March 30th, 2009 (the “Contest Closing Date”).
2. There is one (1) Grand Prize (the “Grand Prize”) and six (6) different Secondary Prizes (the “Secondary Prizes”) available to be won. Grand Prize, sponsored by McCain, will consist of a McCain Healthy Food Makeover Package. This package includes $5,000.00 worth of McCain Healthy Food Coupons (the “Vouchers”) and a Healthy Food Makeover with Rose Reisman. Healthy Food Makeover will be held at the place of residence of the Grand Prize winner. Retail value of the Grand Prize is $6,000.00 CAD. Secondary Prizes awarded depend upon the draw date. The Secondary Prizes, sponsored by the New Brunswick Department of Tourism and Parks, (by draw date), consist of the following New Brunswick Department of Tourism and Parks Getaways: Friday October 31: Kayak the World’s Highest Tides for a family of 4. Includes: 3 hours on the water, snacks on the beach located in Alma, 1 Family Provincial Park Pass, and 1 night accommodation. Retail value of this Secondary Prize is $400.00 CAD. Friday November 28: White Caves Adventure for a family of 4. Includes: a 3 hour walk touring the caves located in Hillsborough, 1 night accommodation, and a Family Provincial Park Pass. Retail value of this Secondary Prize is $375.00 CAD. Wednesday December 31: Miramichi Fish and Canoe Combo for a family of 4. Includes: 1 full day professional guide, equipment, lunch, a salmon dinner in Gray Rapids, and 1 night accommodation. Retail value of this Secondary Prize is $820.00 CAD. Friday January 30: A GORGEous Invitation! for 4 people. Includes: 2 nights in a luxury chalet, 1 hour pontoon boat tour with refreshment and snacks, 1 bottle of wine on arrival, on-site kayak/canoe rental, and hiking trails. Retail value of this Secondary Prize is $450.00 CAD. Friday February 27: World Class Golf Getaway for a family of 4. Includes: 1 night accommodation at the Crowne Plaza Fredericton, full breakfast for 4 people, and 1 round of golf. Retail value of this Secondary Prize is $596.00 CAD. Tuesday March 31: Upriver Adventure for 4 people. Includes: 21/2 hours of canoeing, 1 night accommodation and a Sugarloaf Provincial Park Pass. Retail value of this Secondary Prize is $350.00 CAD.
*Should any of the Secondary Prize winners have additional family members (immediate), packages will be adjusted accordingly.
*Please note: Expiry of all Getaway packages is September 20, 2009.
3. The New Brunswick Department of Wellness, Culture and Sport (the “Promoter”) is not responsible for lost, stolen or otherwise misplaced vouchers from the Grand Prize. Vouchers have no cash value and cannot be redeemed for anything other than the products for which they are intended. Secondary prizes cannot be redeemed for anything other than the outlined items in Section #2.
4. TO ENTER: There are 2 methods of entry. Either visit www.goodnewsforachange.ca and fully complete the online wellness story and contest entry form which includes; Full name (first and last name), complete mailing address, telephone number and email address. Once complete, click “Submit” and you will be automatically entered into the contest. The second method of entry is to attend a Random Acts of Wellness event and participate in the creation of a wellness video. Submission of a wellness video along with the contact information described above will automatically enter you into the contest.
5. To be eligible to win a Prize in the “Goodnewsforachange Contest” you must be a resident of New Brunswick. No purchase necessary. Unlimited number of contest entries per person will be accepted.
6. Prize Winner Selection: SGCI Communications, an independent judging organization, will conduct one (1) random Secondary Prize draw, from all eligible entries received, at approximately 3:00PM AST, on each of the following dates: Friday, October 31, 2008, Friday, November 28, 2008, Wednesday, December 31, 2008, Friday, January 30, 2009, Friday, February 27, 2009 and Tuesday, March 31, 2009 for a total of six (6) Secondary Prize draws. In addition, SGCI Communications will conduct one (1) random Grand Prize draw, from all remaining eligible entries received, at approximately 3:00PM AST, on Tuesday, March 31, 2009.
7. Starting the next business day after each draw date, attempts will be made to contact the entrants selected as eligible for the Grand Prize or Secondary Prize at the telephone number on their online entry forms between 9:00AM and 5:00PM (AST) for a period of 7 business days. If an eligible entrant cannot be contacted in person within the allotted time, he/she is no longer eligible to win and another entrant will be drawn where the same process will be repeated, until the Prize has been successfully awarded. No communication will be entered into except with the selected entrant(s).
8. The odds of being selected depend upon the total number of eligible entries received.
9. Prize may vary depending on availability. All decisions regarding prizing are the sole discretion of the Promoter. All rulings regarding prize fulfillment are final and binding.
10. To be declared a winner, selected entrants must first correctly answer, unaided, a time-limited, mathematical skill-testing question, posed by telephone at a mutually convenient time. The Prize winner must sign a Release and Indemnity form confirming understanding, compliance with and acceptance of the contest rules and acceptance of the Prize and a release of all liability satisfactory to the Promoter, before being declared a Prize winner. The Promoter rulings are final and without appeal in all matters related to the promotion and the awarding of prizes.
11. If applicable, the winners are responsible for all transportation and costs not specifically detailed as being associated with the Grand Prize and Secondary Prizes.
12. Directors, officers, employees and agents of The New Brunswick Department of Wellness, Culture and Sport, their respective partners, affiliates, subsidiaries, suppliers, printers, and distributors, and all persons with whom they are domiciled, are not eligible to participate in this contest.
13. All online stories and contest entry forms become the property of the Promoter and will not be acknowledged or returned. The Promoter will not be responsible for online surveys and contest entry forms delayed, stolen, misdirected, lost or destroyed.
14. The Prize cannot be transferred to another person, or substituted for another prize. All incremental costs in using or claiming the Prize not outlined in this prize description are the sole responsibility of the Prize winner. The Promoter reserves the right to substitute a prize of at least equal value in the event of the unavailability, for whatever reason, of the advertised prizes or any component thereof.
15. Online entries received after 11:59PM (AST) Monday, March 30th, 2009, will be considered null and void and will not be eligible for the Prize draws. Entry forms shall be subject to verification and shall be null and void if they are found to not have been submitted in accordance with these contest rules.
16. The Promoter reserves the right to withdraw or terminate this contest at any time without prior notice or obligation, subject to applicable laws.
17. Privacy Statement: Personal information collected during the administration of this Contest will only be used in conjunction with executing the terms of this Contest unless an entrant has lawfully consented to the use of their personal information, as outlined in the Personal Information Protection and Electronics Documents Act (Canada), for the purpose(s) listed at the time of consent. The declared Prize Winner’s information will be shared with the Promoter and the independent Contest judging organization selected by the Promoter, specifically the Prize winner’s name, mailing address, telephone number and/or e-mail address, only as this information is required to award the Prizes for this Contest.
18. No responsibility is assumed by The New Brunswick Department of Wellness, Culture and Sport, its affiliates, subsidiaries, agencies, their respective directors, officers, nor employees and assigns, for any disruption to telephone network or lines, computer on-line systems, servers or providers, computer equipment, software or failure of any entry to be received because of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, as well as lost, stolen, misdirected, destroyed, illegible, delayed or late entries which for any reason are not received.
19. No liability or responsibility is assumed by The New Brunswick Department of Wellness, Culture and Sport resulting from user attempts to participate in this Contest, or if required, download any information necessary to participate in this contest. In the event of a dispute regarding who submitted an online entry, the entry will be deemed to have been submitted by the authorized account holder of the e-mail address submitted at the time of entry.
20. By accepting a Prize in this Contest, the Prize winner agrees to hold the Promoter, their affiliates, subsidiaries, agencies, their respective directors, officers, employees and assigns, harmless from and against any and all claims and liability arising out of or in any way connected with the operation of this Contest and use of a Prize. The Prize winner assumes all liability for any injury, or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of a Prize. By participating in this Contest, entrants agree to be bound by the Official Contest Rules & Regulations and the decisions of the Contest judges selected by the Promoter.
21. By entering this Contest all entrants, should they win, agree to use of their name, address (city only), photo and/or image on videotape for publicity purposes relating exclusively to this contest without compensation. The New Brunswick Department of Wellness, Culture and Sport reserves the right to disqualify any individual who finds it to be in violation of these Official Contest Rules and Regulations or tampering with the entry process. The New Brunswick Department of Wellness, Culture and Sport reserves the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to enter. Any attempt by anyone to deliberately undermine the legitimate operation of this Contest is in violation of criminal and civil laws and The New Brunswick Department of Wellness, Culture and Sport reserves the right to seek damages or other legal remedy to the fullest extent permitted by law.
22. This contest and the terms and conditions contained in these Official Contest Rules and Regulations, shall be exclusively governed by and construed in accordance with the laws of the Province of New Brunswick, Canada and the federal laws of Canada applicable therein. Any dispute arising hereunder shall be adjudicated solely in the applicable court in New Brunswick, Canada.
23. Where applicable, this Contest is subject to all federal, provincial and municipal laws. Decisions are final in respect to all aspects of this contest.
24. Monthly Prize winners will be reentered for the grand prize draw but secondary winners are not eligible for any subsequent secondary draws (if applicable).
25. This contest is open to all residents of New Brunswick. All entrants who have not reached the age of majority at the time of this contest must have the consent of his/her parent or legal guardian to participate.
26. In the event that a Grand Prize or Secondary Prize winner is a minor, the entrant’s parent or legal guardian will be deemed to be the entrant who must meet all contest eligibility requirements and who may accept the prize on behalf of the minor.
27. The Promoter reserves the right to edit entries in English or French (for error only) for those that are to be posted to the website.
